Terms of Use

Welcome to OnMyScreen. These Terms of Use ("Terms") govern your access to and use of the OnMyScreen mobile application ("App") operated by OnMyScreen ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

2. Account Registration

To use the App, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.

3. Description of Service

OnMyScreen is a social application that allows matched users to share content such as photos, images, text, and emojis with each other. Content shared between matched partners may be displayed on home screen widgets.

4. In-App Purchases and Subscriptions

The App offers optional premium features available through in-app purchases and auto-renewable subscriptions.

• Payment: All purchases are processed through the Apple App Store or Google Play Store. By making a purchase, you agree to the payment terms of the respective platform.
• Subscription Plans: Premium subscriptions are available on monthly and yearly billing cycles. Prices are displayed in the App before purchase.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends.
• Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for the remaining portion of the current period.
• Free Trial: If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled beforehand.
• Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies.

5. User Content

You retain ownership of the content you share through the App. By sharing content, you grant us a limited, non-exclusive license to store, process, and transmit that content solely for the purpose of providing the service to you and your matched partner.

You are solely responsible for the content you share and agree not to share content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory.
• Infringes on the intellectual property rights of others.
• Contains sexually explicit material involving minors.
• Promotes violence, discrimination, or illegal activities.
• Contains malware, viruses, or other harmful software.

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly violate our policies.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Impersonate any person or entity or misrepresent your affiliation.
• Interfere with or disrupt the App's functionality, servers, or networks.
• Attempt to gain unauthorized access to any part of the App or its systems.
• Use automated means (bots, scrapers, etc.) to access the App.
• Harass, bully, or intimidate other users.

7. Intellectual Property

The App, including its design, features, code, graphics, and all related intellectual property, is owned by us and protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in our Privacy Policy.

9. Third-Party Services

The App integrates with third-party services including Google Sign-In, Apple Sign-In, RevenueCat, and Firebase Cloud Messaging. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

10. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or damages resulting from user content shared through the App.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the App. You may also delete your account at any time through the App. Upon termination, your right to use the App ceases immediately and your data will be handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App or by other appropriate means. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
